I’m considering the legality of this request but I seem to remember this was a thread by a troll and hardly seems very important…

Subject: LEGAL MATTER – PLEASE REMOVE DEFAMATORY MATERIALDear Sir
There is a reference to Gail McKenna and Kathy LLoyd on your website at http://www.partyvibe.com/vbulletin/showthread.php?t=18603
Please remove it and all references to Gail on your website. This is defamatory material, and it should be removed.
I refer you to the following regarding this matter so please make sure to remove it as soon as possible.
Thank you for your kind co-operation.
John Clarkson
Please note:-
Website Hosts liable for defamatory material.Website hosts may be liable for defamatory material created by someone else but which they host. However, there are special defences available to hosts under the Defamation Act 1996 and the E-commerce Regulations.
Under the Defamation Act 1996, a website host will have a defence to a claim for libel if he can show that (i) he was not the author, editor or publisher of the statement complained of, (ii) he took reasonable care in relation to its publication, and (iii) he did not know and had no reason to believe that what he did caused or contributed to the publication of the defamatory statement. The defence under the E-commerce Regulations is expressed in similar terms.
In order to have the best chance of taking advantage of these defences, a host should not as a matter of course monitor/edit the content of websites that it hosts; however as soon as the host becomes aware of potentially defamatory content, that content should be quickly removed.

Oct 2nd, 2005 – 5:09 PM Re: The Burial
Okay, just forgetting the maps for a moment I want to look at the motivations behind Kidd burying his treasure. I’ll assume we’re talking about treasure before or after the Quedah Merchant while he’s in the Indian Ocean.
1. As you state there are no banks. Thus he has two options: secret burial or take it with him. His crew is always potentially mutinous, like any crew! Thus he doesn’t trust them, either to bury it or keep it.
2. Let’s assume a few of his top men decide to bury the treasure. If this is the case can he trust them in the future?
3. How much did the treasure weigh (assuming its just coins in a sailor’s chest)? How far did they carry it? Was it up hill or down hill? What type of terrain? These are basic but important questions we need to ask if your island is the right one.
3. Did he, R L Stevenson style, kill those who buried it for him?
4. During the burial the rest of the crew have to be suitably distracted not to notice what is going on. Drink and women, perhaps local natives could be used for this purpose. How does he achieve this on such a small island?
5. Then if all is successful at a later date he has to trust another crew to help him recover the money.
Okay, putting myself in Captain Kidd’s shoes, I’m not convinced that he would have buried the treasure at any time unless he was under great stress – to hide evidence from the authorities – or from another pirate who knew what he had done.
But I’m interested in your answers to the other questions assuming your maps are right?
I’m still interested in this idea and would help to raise some funds for an expedition if you can convince me!
